No-Spam Policy

Spamming is strictly prohibited on TumaFare. This includes:

• Creating multiple accounts to circumvent restrictions or bans
• Sending numerous small transactions to harass or test the system
• Using the platform for purposes other than legitimate transport fare or marketplace escrow
• Any activity that degrades the experience for other users

Violation results in immediate account termination and potential legal action.

Transport — Sender Responsibilities

Transport senders agree to:

• Only send fare with genuine intent to support the recipient's travel
• Respond promptly to recipient arrival notifications
• Approve payouts when recipients genuinely arrive at the destination
• Not abuse the reject function to withhold funds unfairly

Senders who repeatedly reject valid approvals without reason will be banned.

Transport — Recipient Responsibilities

Transport recipients agree to:

• Have genuine intent to travel to the agreed destination
• Only mark "On the Way" when actually departing
• Only mark "Arrived" when physically present at the destination
• Provide honest updates and valid reasons for any delays

Recipients who ghost senders or falsely claim arrivals will be permanently banned.

Marketplace — Seller Responsibilities

Marketplace sellers agree to:

• List items accurately — correct description, condition, and photos
• Ship only after confirming "FUNDED" status on their dashboard
• Ship the exact item listed — not a substitute, empty box, or damaged alternative
• Not share the handover code with the buyer before physical delivery
• Cooperate fully with dispute investigations if raised by a buyer

Sellers who ship wrong or counterfeit items face funds hold, permanent ban, and potential legal action.

Marketplace — Buyer Responsibilities

Marketplace buyers agree to:

• Fund the escrow with genuine intent to purchase at the agreed price
• Be physically present at the agreed GPS meeting point for delivery
• Only reject a delivery if the item materially differs from the listing — not for price renegotiation
• Not attempt to obtain the handover code through any means other than direct verbal communication with the rider at the meeting point
• Not claim delivery confirmation without physically receiving the item

Buyers who falsely reject deliveries or attempt code fraud will be permanently banned.

Technology Disclaimer

While we strive for 100% uptime, TumaFare does not guarantee uninterrupted service. SMS delivery depends on third-party providers (MTN, Airtel, Safaricom) and may be subject to network conditions, maintenance windows, and regulatory restrictions. GPS accuracy depends on the buyer's device and may have a margin of error. Users in Kenya should note that M-PESA SMS OTPs are restricted outside 6AM–10PM EAT hours.

Financial Disclaimer

TumaFare is operated by Tesa Agency and is not a bank, financial institution, or regulated money transmitter. We provide escrow technology that facilitates conditional fund transfers between users. Funds are held in trust accounts but are not deposit-insured. Mobile Money transactions are processed through licensed payment providers (Pawapay). Service fees are non-refundable once a transaction is initiated.

Dispute Resolution

Disputes should first be resolved through direct communication between parties. TumaFare may, at its discretion, review transaction evidence — including GPS data, proof photos, handover code logs, and timestamps — to make a determination. For marketplace disputes, rider delivery logs may also be reviewed. Our platform determination is final for escrow release purposes, though users retain the right to seek independent legal remedies.
